A 47-year-old mechanic, Ayobami Akindele has allegedly raped and defiled his neighbour’s daughter.
Our reporter was at the Ikeja Magistrates Court, Lagos, when Akindele, who allegedly defiled the 12-year-old girl in the bathroom was released on a N300,000 bail on Wednesday.
Akindele, who entered a `not-guilty’ plea to the charges of indecent treatment of a child and defilement, is a resident of Apesin Street, Mushin, Lagos.
An Ikeja Magistrates’ Court which gave the ruling, also asked the accused to produce two sureties as part of the bail condition.
The Magistrate, Mrs F A. Azeez said that one of the sureties must be a religion leader and the other a blood relation and both should show evidences of two years’ tax payment to the Lagos State Government.
According to the prosecutor, Sgt. Emmaunel Ajayi, the accused committed the offences on May 28 at his residence.
He said that the accused unlawfully had sexual intercourse with his neighbour’s 12-year-old girl.
Ajayi said that the accused sneaked into the bathroom where the girl was bathing and had canal knowledge of her.
“The accused was sitting idle at the passage when the girl passed with a bucket of water to bath.
“The accused followed her and sneaked into the bathroom, he started sucking her breasts.
“He dipped his finger in her vaginal and started fingering it, the victim was crying and was in pain but the accused was begging her, promise to give her money.
“He covered the girl’s mouth with towel and forced his manhood inside the her vaginal.
“When the girl’s mother came home in the evening, her daughter was complaining of stomach ache.
“As she was trying to get what got wrong, she discovered blood stain on her clothes.
“Her mother asked her what happened to her and she told her everything that transpired between her and the accused.
“The girl’s mother reported the case to the police station,” he said.
The prosecutor said that the girl was taken to the hospital where medical report showed that there was forcefully penetration which led to bruises in the girl’s vagina.
However, the magistrate, ordered the investigating police officer to duplicate and forward the case file to the Director of Public Prosecutions(DPP) for legal advices.
The offences contravened sections 137 and 139 of the Criminal Law of Lagos State, 2015 (Revised).
Section 139 prescribes life imprisonment as penalty for defilement.
The magistrate adjourned the case until June 13 for mention.
